Las Cruces man accused of not being neighborly

David Bernal, 28, of the 1700 block of west Hadley Avenue, is charged with one count of aggravated battery with a deadly weapon. The charge is a third-degree felony.

A man sitting outside his home watching fireworks pop off was allegedly assaulted by his neighbor.

The victim was approached by his neighbor David Bernal, 28, around midnight, said Las Cruces police.

Bernal was asking his neighbor for marijuana and became confrontational with the victim by striking his head with a broken liquor bottle, said police.

They said Bernal left the scene but was taken into custody when police arrived at his home in the 1700 block of west Hadley Avenue.

The broken bottle was found inside Bernal's home.

The victim was taken to the hospital for injuries to his face, neck and head, said police.

His injuries are not believed to be life-threatening.

Bernal was booked into the Dona Ana County Detention Center where he is initially being held without bond.
