Trial day 3 for Las Cruces man accused of stabbing another man to death at a house party

Lawrence Lucero is accused of stabbing another man to death during a fight at a house party in 2014.

Prosecutors requested a mistrial after they said the defense asked an inappropriate question to the man who was with Lucero the night of the stabbing.

Wednesday was day three of the trial.

Lucero is accused of stabbing David Escamilla to death at the 2014 party.

On Wednesday, Ismael Montoya testified to being with Lucero the night of the stabbing.

Montoya, who was also charged in the murder, testified that Lucero admitted to stabbing Escamilla.

Montoya told the defense he wasn’t the one who stabbed Escamilla.

That’s when defense attorney Raymond Conley asked, “If that’s the case, you didn’t do it, why in the world didn’t you tell police that, that night?”

Prosecutors said that the defense's question could damage Montoya’s credibility with jurors.

But Montoya’s attorney stated that he advised Montoya not to speak to police.

The prosecution called for a mistrial, but later withdrew the request.

The trial will continue Thursday morning.
